Trial terms of use
This is a translation for convenience. The German version is legally binding.
1. Provider and scope
- These terms apply to the use of a trial instance of eunom.io (“trial instance”). The provider is Nicolas Lepke Baroni, a private individual (address in the legal notice), hereinafter the “provider”.
- The trial instance serves exclusively to get to know and try out eunom.io. It is provided free of charge. Registration does not create a contract for paid services.
- The trial is aimed at people evaluating eunom.io for a company or organisation and requires a minimum age of 18.
- Deviating terms of the user do not apply.
2. Registration
- To obtain a trial, the user registers on eunom.io and confirms their email address via a link sent to them. The details provided must be accurate.
- Upon confirmation, the user agreement on these terms is concluded. There is no entitlement to the setup of a trial instance.
- The number of simultaneous trial instances is limited. If none is free, the user can join a waiting list. When a place becomes free, the user is notified by email; the place is then reserved for them for 24 hours and afterwards passes to the next person on the list.
3. Service and term
- The user receives access to their own trial instance with sample data for three days. They can invite up to nine more people and assign them roles.
- After the three days, the trial instance and all content stored in it are deleted. The provider gives notice by email one day before. Extension or transfer of the content to another instance is not provided for.
- Trial instances are not backed up. Content may be lost at any time, including before the three days have expired.
- The trial instance is provided without warranty as to availability, freedom from errors or any particular scope of functions. The provider may change or restrict functions or discontinue the trial at any time. The sample data and pre-selected requirements do not constitute legal or professional advice.
4. Obligations of the user
- The user does not enter real company data, confidential information, trade secrets or personal data of third parties into the trial instance. Excepted are the name and email address of invited people, insofar as necessary for their access.
- If the user invites other people, they ensure that these people also comply with the terms and inform them about the processing of their data under the privacy policy.
- The user keeps their access details secret.
- Prohibited in particular are: unlawful content; attempts to circumvent protective measures or usage limits; attacks on the trial instance, other instances or the infrastructure, including load and security tests without prior consent in text form; automated mass retrieval; reselling or passing on access to third parties.
- Reports of security vulnerabilities are welcome and should be sent to info@eunom.io.
5. Liability
- The provider is liable without limitation for intent and gross negligence, for damage arising from injury to life, body or health, under the German Product Liability Act and for fraudulently concealed defects.
- Otherwise, liability is excluded. This corresponds to the statutory standard of liability for gratuitous provision (cf. Section 599 of the German Civil Code, BGB).
- For the loss of content, the provider is in no case liable beyond clause 5.1. The user is aware that trial instances are not backed up and are deleted after three days (clause 3).
- These limitations of liability also apply in favour of persons whom the provider uses to perform their obligations.
6. Termination and suspension
- Either party may end the use at any time without giving reasons. The user can do so by emailing info@eunom.io; the trial instance is then deleted early.
- In the event of a breach of these terms, the provider may suspend access immediately and delete the trial instance.
7. Data protection
How the provider processes personal data during registration and the trial is set out in the privacy policy. Consent to marketing is voluntary and not a condition for the trial.
8. Changes
The provider may change these terms for future registrations. A running trial instance is governed by the version accepted at registration. The version is shown at the top of this page and is stored with the time of acceptance at registration.
9. Final provisions
- The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the state of their habitual residence.
- Should any provision be invalid, the remainder remains valid.
- These terms are available in German, English and Spanish. The German version is authoritative.
